Terms of Service

These Terms of Service ("Terms") govern your use of GPTRapid ("Service"), operated by HarwoodLabs ("we," "our," or "us"). By using GPTRapid, you agree to these Terms.

1. Service Description

GPTRapid provides a lightweight interface to access OpenAI's language models. We are not affiliated with, endorsed by, or partnered with OpenAI. The AI capabilities are provided by OpenAI's API.

Service Tiers

  • Lite ($4.99/month): User provides their own OpenAI API key. Unlimited usage based on user's OpenAI account.
  • Pro ($14.99/month): We provide API access. Limited to 500 messages per day.

2. Account Registration

To use GPTRapid, you must:

  • Provide a valid email address
  • Be at least 13 years old (18 in some jurisdictions)
  • Provide accurate and complete information
  • Maintain the security of your account credentials

You are responsible for all activity under your account.

3. Subscription and Billing

Free Trial

  • 7-day free trial for new users
  • No credit card required to start trial
  • Full access to selected tier features during trial

Billing

  • Subscriptions are billed monthly
  • Payment is processed securely by Stripe
  • Prices are in USD unless otherwise specified

Cancellation

  • Cancel anytime from your account settings
  • Access continues until the end of your billing period
  • No partial refunds for unused time

Refunds

  • We do not offer refunds for partial months
  • Exceptions may be made at our sole discretion for technical issues

4. Acceptable Use

You agree NOT to use GPTRapid for:

  • Illegal activities or promoting illegal acts
  • Generating harmful, abusive, threatening, or harassing content
  • Creating content that exploits or harms minors
  • Generating spam, malware, or phishing content
  • Attempting to circumvent usage limits or security measures
  • Reverse engineering or copying the Service
  • Reselling, redistributing, or sharing account access
  • Violating OpenAI's Usage Policies
  • Any activity that disrupts or burdens the Service

We reserve the right to terminate accounts that violate these terms without refund.

5. API Keys (Lite Tier)

If you use the Lite tier with your own API key:

  • You are solely responsible for your OpenAI account and charges
  • Keep your API key confidential
  • We are not liable for charges incurred on your OpenAI account
  • Your key is stored locally on your device; we never access it

6. Content and Data

Your Content

  • You retain ownership of content you create
  • You are responsible for ensuring your use complies with applicable laws
  • We do not access, review, or store your conversations

AI-Generated Content

  • AI responses may be inaccurate, incomplete, or biased
  • Always verify important information independently
  • We are not responsible for decisions made based on AI output
  • AI content should not be considered professional advice (legal, medical, financial, etc.)

7. Intellectual Property

  • GPTRapid and its original content are owned by HarwoodLabs
  • Our trademarks may not be used without written permission
  • AI models are owned by OpenAI and subject to their terms

8. Service Availability

  • We strive for high uptime but do not guarantee uninterrupted service
  • We may modify, suspend, or discontinue features with reasonable notice
  • AI model availability depends on OpenAI
  • Scheduled maintenance will be communicated when possible

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • GPTRapid is provided "AS IS" without warranties of any kind
  • We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability is limited to the amount you paid us in the 12 months preceding the claim
  • We are not liable for any third-party actions, including OpenAI

10. Indemnification

You agree to indemnify and hold harmless HarwoodLabs, its officers, employees, and agents from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you create using the Service

11. Termination

By You

  • Cancel anytime from account settings
  • Request account deletion via support@gptrapid.com

By Us

  • We may terminate or suspend accounts that violate these Terms
  • We may terminate for prolonged inactivity (12+ months)
  • We will provide notice when reasonably possible

Upon termination:

  • Your right to use the Service ends immediately
  • Data associated with your account will be deleted within 30 days

12. Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of California, USA.

Informal Resolution

Before filing any claim, you agree to contact us at support@gptrapid.com to attempt informal resolution.

Arbitration

Any disputes not resolved informally shall be resolved by binding arbitration in California, except for claims that may be brought in small claims court.

Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class actions.

13. Changes to Terms

  • We may update these Terms periodically
  • Material changes will be communicated via email or in-app notification
  • Continued use after changes constitutes acceptance
  • If you disagree with changes, discontinue use and cancel your subscription

14. Miscellaneous

  • Severability: If any provision is found unenforceable, other provisions remain in effect
  • Waiver: Failure to enforce a right does not waive that right
  • Assignment: We may assign these Terms; you may not
  • Entire Agreement: These Terms constitute the entire agreement between you and HarwoodLabs regarding the Service
